Legal Services for Individuals

Private Employee Retirement Benefits
We prepare and file QDROs on behalf of employees (plan participants) or an employee's former spouse, spouse, children or other dependents (alternate payees). In most cases, a QDRO carries out the division of retirement benefits pursuant to divorce; however, a QDRO can also be utilized to satisfy alimony or child support payments and/or arrearages from an employee's retirement benefits account.

Federal Civil Service Retirement Benefits
Federal retirement benefits are subject to division by court orders similar to QDROs. We prepare and file Court Orders Acceptable for Processing (COAPs), applicable to benefits payable under the Civil Service Retirement System or Federal Employees Retirement System, and Retirement Benefits Court Orders (RBCOs), applicable to benefits payable from the Thrift Savings Plan, on behalf of federal government employees or their spouses, former spouses, children or other dependents.

Legal Services for Family Law Attorneys
We assist family law attorneys with drafting divorce settlement agreement language which will ensure the proper division of all aspects of retirement benefits. We offer consultation with respect to the tax implications of the division of retirement benefits and other marital property (including marital residences and stock options) and the structuring of alimony payments. In the event you have a client on behalf of whom a QDRO should have been filed and either was not filed or was never finally qualified by the plan administrator, we will review such cases and often can still file a QDRO, even many years after the divorce.

Legal Services for Employers
For our business clients we provide written QDRO guidelines specifically tailored to the terms of the retirement plan and the procedural requirements of the employer. Department of Labor regulations require retirement plan sponsors to provide written QDRO guidelines to participants and alternate payees in order to apprise the parties to a QDRO of their rights and obligations and those of the Plan Administrator during the QDRO qualification process. As part of these guidelines, we can also provide model QDROs.
